The process in this scenario is known as the Letter of Administration (LA). LA is known as an instrument issued by a court or public official authorizing an administrator to take control of and dispose of the estate of a deceased person.
The administrator will be appointed among your surviving beneficiaries in accordance to the Distribution Act 1958.
The appointed Administrator then, shall proceed with the application known as the Letter of Administration.

FAQ ON LETTER OF ADMINISTRATION

You have to prepare the following:-
a. death certificate;
b. identity card (IC) of the Administrator;
c. list and identity cards (IC) of the Beneficiaries;
d. list of assets of the deceased;
e. list of liabilities of the deceased; and
f. administration oath if there is any minor interest,
g. renunciation by other beneficiaries who are entitled to the grant but did not apply; and
h. any other documents that the lawyer required from time to time.

Here is the procedure to apply Letter of Administration in Malaysia:
1. You will have to appoint an administrator on behalf of the deceased.
2. The administrator and all the beneficiaries will have to sign all related documents.
3. The court will fix a hearing date which the administrator will have to attend to the Court to provide the necessary information.
An administrator is a person who represents the deceased and helps the deceased to administer all the estate/property that belongs to the deceased.
The duty of the administrator includes:
Utilize the assets of the estate to pay for funeral expenses of the deceased and the costs in obtaining the grant of LA.
Pay of debts & liabilities of the deceased.
Distribute the remaining balance of the estate to all beneficiaries.
