FAQ ON GRANT OF PROBATE

The Grant of Probate is an application when the Executor named in a will executes the demise's Will. Meaning, if you die living a Functional Will, then the Grant of Probate shall be applied by your Executor whom you named in your Will.

Grant of Probate is issued by the High Court to the named Executor(s) in a Will. Once the Grant of Probate has been issued, the Executor(s) named in the Will is authorized to administer the estate of the deceased.

You have to prepare the following:-

a. death certificate;
b. the original Will;
c. identity card (IC) of the Executor;
d. list and identity cards (IC) of the Beneficiaries;
e. list of assets of the deceased;
f. list of liabilities of the deceased; and
g. any other documents that the lawyer required from time to time.

If a beneficiary believes that the executor is not fulfilling their legal obligations, the beneficiary can appoint a lawyer to file for a petition to either demand a complete audit of the estate’s assets or to eliminate the executor.
